120P - Policy Formulation, Adoption, and Revision

Policy Formulation
It is the responsibility of the School Board to adopt policies for governing the school division. The power to enact policy cannot be delegated to an employee or agent such as the Superintendent or a single member of the School Board.

Policy is a basic statement of the intent of the School Board which creates rights and responsibilities for the conduct of the school division’s business. Policies are subject to revision by the School Board and the final authority for adoption rests solely with the School Board.

Unless otherwise provided, when policies are adopted, amended or replaced, the new or revised policy shall become effective upon adoption.

All regulations for implementation of the policies shall be developed by or through the Superintendent.

Policy Adoption and Revision
Policy proposals and suggested revisions to existing policies shall be submitted in writing to all members of the School Board through the Superintendent prior to the regularly scheduled board meeting during which such proposed policies or revisions will be considered by the Board. With the exception of School Board Bylaws, the Board may take action on proposed policies or policy revisions during the meeting at which the proposed policies or revisions initially appear on the Board’s meeting agenda. A majority vote by the Board is required to adopt policy and policy revisions.

Bylaw Adoption and Revision
Proposed School Board Bylaws and revisions to existing Bylaws shall be submitted in writing to all members of the School Board through the Superintendent prior to the regularly scheduled board meeting during which such proposed Bylaws or revisions will be considered by the Board. The Board shall hold a first reading on proposed Bylaws or revisions to Bylaws during the meeting at which the proposed Bylaw or revision initially appears on the Board’s meeting agenda. At the next succeeding meeting of the Board, the Board may take action on the proposed Bylaw or revision to an existing Bylaw. A two-thirds vote is required for adoption or revision of a School Board Bylaw.

Policy Review
School Board policies shall be reviewed at least every five years and revised as needed.
